Terms of Use

These Terms of Use govern access to and use of the dulceglucosa.com website and the Dulce mobile application (together, the "Service"). By using the Service you accept these terms. If you don't accept them, don't use the Service.

⚠️ Dulce is not a medical device. It does not diagnose, treat, cure or prevent any disease. Treatment decisions should always be made with your healthcare team.

1. Acceptance

By signing up to the waitlist, applying for the beta or using the Dulce app, you confirm that you have read, understand and accept these terms and our Privacy Policy.

2. Service description

Dulce is a companion application for people with diabetes (especially type 1) and their carers. The Service allows, among other things:

  • Viewing glucose data coming from your CGM (LibreLinkUp, Dexcom Share, Nightscout) on your own device.
  • Keeping a manual logbook of food, insulin, exercise and notes.
  • Showing trends and statistics based on your own data.
  • Optionally sharing selected information with trusted contacts (planned for future versions).

3. Medical notice

Dulce is not a medical device or a substitute for professional judgement. The Service does not recommend insulin doses, does not diagnose or treat any condition, and must not be used to make clinical decisions instead of your endocrinologist, primary care physician or other healthcare professionals.

In particular, the glucose data shown by Dulce comes from your CGM and is subject to its own technical limitations, reading delays and possible errors. For critical decisions (especially severe hypoglycaemia), always confirm with a fingerstick meter.

4. Eligibility

To use the Service you must be at least 14 years old. If you are between 14 and 18, you need consent from a parent or legal guardian. If you manage an account on behalf of a minor, you are responsible for doing so in accordance with applicable law.

5. Accounts and credentials

You are responsible for the confidentiality of credentials used to access third-party services (LibreLinkUp, Dexcom, Nightscout). Dulce encrypts them and stores them in the secure keychain of your device, but we cannot recover lost credentials on behalf of the original provider.

6. License

We grant you a limited, non-exclusive, non-transferable and revocable license to use Dulce in accordance with these terms and for personal, non-commercial use.

7. Prohibited conduct

You may not:

  • Use the Service for unlawful purposes or in ways that infringe third-party rights.
  • Attempt to access systems, data or accounts you are not authorized to access.
  • Reverse engineer or circumvent technical protection measures, except to the extent allowed by applicable law.
  • Automate mass form submission or spam our infrastructure.

8. Subscriptions (future)

During the beta, the Service is free. In the future we may offer subscription plans with additional features. When we do, we will publish specific terms for those plans (price, period, cancellation, EU consumer right of withdrawal, etc.).

9. Third-party services

Dulce may connect to third-party services that you choose (Abbott LibreLinkUp, Dexcom, Nightscout, Apple Health). Use of those services is governed by their own terms and policies. We are not responsible for their availability, accuracy or changes.

10. Intellectual property

The Service, including code, design, brand and content published by us, is owned by Dulce and its licensors. Data you contribute (your logbook, your settings) remains yours.

11. Disclaimer of warranties

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we do not warrant that it will be uninterrupted, error-free, 100% secure, or that it will meet specific expectations. This is especially relevant for data from third-party CGMs: any delay, error or absence of data from the original provider may be reflected in Dulce.

12. Limitation of liability

To the maximum extent permitted by law, Dulce shall not be liable for indirect, consequential damages, loss of profits or loss of data arising from the use or inability to use the Service. Nothing in these terms limits our liability for wilful misconduct or gross negligence, health damages caused by negligence, or any liability that cannot be excluded by law.

13. Indemnification

You agree to indemnify Dulce against any third-party claims arising from your use of the Service in breach of these terms or of the law.

14. Changes to the Service or these terms

We may modify the Service and these terms to reflect new features, legal requirements or security considerations. We will let you know by email or inside the Service when the changes are material.

15. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these terms or if you compromise the security or lawfulness of the Service.

16. Governing law and jurisdiction

These terms are governed by the laws of Spain and applicable European Union regulations. For consumers with habitual residence in the EU, the courts of their place of residence shall have jurisdiction. For others, the courts of the city of the Service operator's residence in Spain.
